Tikiwini is a company registered in England and Wales under Company Number 14002483 (CRN), with its registered address at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom, acting as a disclosed agent for the supplier, for passenger services between the departure points and destinations specified at the time these services are booked and paid for.

Since Tikiwini is a booking service for passenger transport services at all times acting as the disclosed agent of the supplier specified at the time the services are booked (or the supplier providing the services, should this supplier be different to that specified at time of booking) and paid for by you and confirmed by Tikiwini (“the booking”), by arranging the services through Us with the relevant supplier, users who access, use, purchase and/or book the Services (collectively or individually “You” or “Your” or “User” or “Users”) agree to be bound by and do so under these terms and conditions (the “Terms and Conditions”) (as they may be modified and posted on our website or app from time to time) as well as other information contained on the website, app, email or any other form of electronic or written communication with you.

The Terms and Conditions provide the rules for Your use of the Services. By using the Services, You are agreeing to be bound by the Terms and Conditions, including Our Privacy Policy, so it is important that You read these Terms and Conditions carefully before You create an account or book a ride. We may also update these Terms and Conditions from time to time, so please check back regularly for updates.

In addition, please note that, by using the Services, You agree that We may use Your personal data as set forth in Our Privacy Policy. These Terms and Conditions include but are not limited to Standard Terms and Conditions and Services Terms of Use.

1. Summary of Services and Acceptance

These Standard Terms and Conditions (the “Terms”) govern access to and use of the Tikiwini platform (“Tikiwini”, “Us”, “We”, “Our”), including Our website, mobile applications, and any related digital booking channels (collectively, the “Services”).

Our Services are limited to helping You arrange transportation provided by third-party transport service providers. We do not ourselves provide carriage or transportation services. We act as an intermediary and disclosed agent to facilitate the booking of transport services between You and the relevant supplier.

By using Our Services, You acknowledge and agree that transportation services are provided by third-party suppliers, and that Your use of the Services constitutes acceptance of these Terms. Please read these Terms carefully before using the website, the Services, or any mobile application. If You do not agree to these Terms, You must not use the Services.

We may update these Terms from time to time without prior notice, and any changes will become effective on the date they are posted on the Platform. Continued use of the Services after such changes have been posted constitutes Your acceptance of the updated Terms.

2. Use of the Website, the Services, and the Mobile App

You may only use the website, the Services, and any mobile application in accordance with these Terms and for lawful purposes. You agree not to misuse the Platform or use it in any way that may interfere with its proper operation or infringe the rights of Tikiwini, transport suppliers, or any third party.

You agree not to use the Services to transmit or distribute unlawful, misleading, fraudulent, harmful, defamatory, obscene, or otherwise objectionable material, or to upload software, code, or other content intended to damage, disrupt, or gain unauthorized access to any system, account, or network.

You further agree not to exceed any permitted access, attempt to gain unauthorized access to the Platform, resell access to the Services without written authorization, or create links or framed versions of the Platform in a misleading or unauthorized manner. We reserve the right to suspend or terminate access to the Services at any time if We determine that these Terms have been violated.

3. Your Account

You are responsible for maintaining the confidentiality of Your account details, including login credentials and passwords, and for restricting access to Your devices. You are responsible for all activity carried out under Your account unless caused by Our own fault.

You may not assign, transfer, or share Your account with another person without Our prior written consent. Tikiwini shall not be responsible for unauthorized access to Your account resulting from Your failure to protect Your credentials or devices.

We reserve the right, in Our sole discretion and without prior notice where permitted by law, to refuse or cancel Services, suspend or terminate accounts, or remove or edit content associated with an account where We believe there has been misuse, fraud, breach of these Terms, or other unlawful or harmful activity.

4. Privacy

The use of Our Services is subject to Our Privacy Policy, which governs the use of the website and mobile application and is incorporated into these Terms by reference. We take Your privacy and data security seriously. By using the Services, You agree that We may collect, use, and share Your personal data as described in Our Privacy Policy.

By visiting the website, using the mobile application, or sending an email to Us, You consent to receive electronic communications from Us, including agreements, notices, disclosures, and other communications. The Platform may include links to third-party websites or services (“Linked Sites”). These Linked Sites are not owned or controlled by Tikiwini, and We are not responsible for their content, updates, or practices. If You choose to use or purchase any third-party product, service, or functionality through the Platform, You agree that We may share the information necessary to fulfill Your request with the relevant third-party provider.

7. Services Are Not Available for Children

If You are under the age of eighteen (18), You may use the Services only with the permission and involvement of a parent or legal guardian.

8. Warranty Disclaimer

THE WEBSITE, THE SERVICES, THE MOBILE APPLICATION, AND ALL INFORMATION PROVIDED THROUGH THEM ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIKIWINI DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, AND QUIET ENJOYMENT.

TIKIWINI DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

9. Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIKIWINI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, THE SERVICES, ANY LINKED SITES, OR ANY THIRD-PARTY SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIKIWINI’S TOTAL AGGREGATE LIABILITY FOR ANY DIRECT DAMAGES ARISING OUT OF OR RELATING TO THE SERVICES SHALL BE LIMITED TO THE GREATER OF (1) THE AMOUNT PAID BY YOU FOR THE RELEVANT SERVICE GIVING RISE TO THE CLAIM OR (2) FIFTY EUROS (€50).

10. Booking and Payment

Bookings may be made online through Our website or mobile application. Where a booking includes two or more people, the person making the booking is deemed to do so on behalf of all passengers included in the booking and accepts these Terms on behalf of each of them.

Full payment may be required either at the time of booking, before the use of the Services, or upon completion of the journey, depending on the service type and payment option offered at the time of booking.

Payments may be processed through third-party payment processors. The processing of payments is subject to the terms, conditions, and privacy policies of those providers and of the payment card issuer. Tikiwini is not responsible for errors made by third-party payment processors.

11. Waiver; Remedies

Any failure by Tikiwini to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. All rights and remedies available to Tikiwini under these Terms or by law are cumulative and may be exercised independently.

12. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them, including any non-contractual disputes or claims, shall be governed by and construed in accordance with the laws of England and Wales.

You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Services.

13. Support and Safety; Force Majeure

From time to time, We may perform maintenance on or upgrade the Platform, which may result in temporary suspension or limitation of the Services. We shall not be liable for any delay, interruption, or failure to perform resulting from events beyond Our reasonable control.

Such events may include, without limitation, severe weather, flood, earthquake, fire, natural disaster, pandemic, disease outbreak, strike, riot, war, terrorism, civil disorder, public authority action, changes in law, technical network failure, or public carrier disruption.

14. Term and Termination

These Terms become effective as soon as You access the website, use the mobile application, or use any part of the Services, and remain effective unless and until terminated in accordance with these Terms or applicable law.

15. Entire Agreement

These Terms, together with any additional service terms, policies, and notices published on the Platform, constitute the entire agreement between You and Tikiwini regarding the Services and supersede any prior discussions, communications, understandings, or agreements.

16. Changes to Terms

We reserve the right, in Our sole discretion, to amend or update these Terms at any time. Any such amendments will become effective when published on the Platform. Your continued use of the Services after publication of updated Terms constitutes Your acceptance of those changes.

PERSONS USING THE SERVICES OF TIKIWINI ARE SUBJECT TO THE FOLLOWING SERVICES TERMS OF USE, IN ADDITION TO OUR STANDARD TERMS AND CONDITIONS, WHICH ARE INCORPORATED BY REFERENCE INTO THESE TERMS. USE OF OUR SERVICES IS PROHIBITED WITHOUT ACCEPTANCE OF AND AGREEMENT TO THESE SERVICES TERMS OF USE.

References to “You” and “Your” mean the person using Our services, and references to “We”, “Us”, “Our”, or “Tikiwini” mean Tikiwini. We reserve the right to modify, amend, or cancel these Services Terms of Use in Our sole discretion.

Tikiwini is a ground transportation booking platform providing access to transport-related services through a single platform, including Pre-booked Transfer Services, Shared Shuttle Transfer Services, Ride Hailing Services, and Rail Tickets Transfer Services. As described in the Standard Terms and Conditions, all transport services referenced herein are provided by third-party service providers and not by Tikiwini.

i. Pre-booked Transfer Service Terms

1. Waiting Period for Airport Transfer Services

Pickup services, including airport, train station, and port transfers, generally include a free waiting period of up to sixty (60) minutes. For drop-off rides, a free waiting period of fifteen (15) minutes is generally included. Additional fees may apply if these waiting periods are exceeded.

2. Extra Stops

You may ask the driver to make additional stops during the ride. Extra charges may apply depending on the number of stops, the time spent, and the distance added to the original route.

3. Hourly Booking / Private Tour

These transportation services are charged based on the booked time period. Additional charges may apply if the hired time is exceeded. Unless otherwise stated, there is no mileage limit during the booked hourly period.

4. Child Seats

The first child seat or infant seat may be provided upon request at no extra charge, while additional child seats may be chargeable. Requests should be made during the booking process. If requested after booking, fulfillment depends on seat availability and reasonable efforts by the transport provider.

5. Rates

Transportation services booked through Tikiwini are generally charged in full once the booking has been confirmed, unless a deposit option is expressly offered. Where a deposit option is offered, the remaining balance may be deducted from the original payment method on the due date indicated at the time of booking. Unless otherwise specified, fares may include taxes, tolls, and similar mandatory charges.

6. Disputed Charges

You agree to notify Us of any objection to fees or charges within fourteen (14) days of the charge date. After that period, charges may be treated as final and non-refundable to the extent permitted by law.

7. Damages Resulting from Your Act

You are responsible for any damage or expense caused by You or any passenger for whom You arranged transportation, including fines, repair costs, cleaning costs, and legal fees arising from damage to the vehicle or improper conduct during the trip.

8. No Shows

After the included waiting period has expired, the driver may attempt to contact You to arrange additional waiting time. If You cannot be reached using the contact information provided, the booking may be treated as a no-show and may be non-refundable in accordance with the applicable cancellation policy.

9. Number of Passengers

Vehicles are insured and assigned according to the maximum number of passengers and luggage capacity. You are responsible for selecting a vehicle category suitable for Your party size and baggage. Safety regulations may prohibit exceptions.

10. Payments

Payment in full may be required to confirm a transportation booking unless another payment arrangement is expressly offered by Tikiwini at checkout.

11. Reservations

Reservations should generally be made at least twenty-four (24) hours in advance to improve availability and service quality. Bookings made within twenty-four (24) hours of the requested service time are subject to vehicle availability and reasonable efforts.

12. Vehicle Categories; Upgrades

You may choose among available vehicle categories, such as Sedan, Minivan, Minibus, or similar categories shown on the Platform. Vehicle images are illustrative only and do not guarantee a specific model or color. If necessary, Tikiwini or the supplier may provide a larger category vehicle at no additional charge.

13. Pet and Service Animals

Pets and service animals may be allowed inside a booked vehicle provided notice is given during the booking process and subject to the policy of the relevant transport provider and applicable law.

14. Smoking Policy

Smoking or vaping inside any vehicle booked through Tikiwini is strictly prohibited. Cleaning fees, trip termination, or non-refund may apply in the event of a breach of this rule.

15. Refunds and Cancellation Policy

If You cancel a booked service, refund eligibility will depend on the cancellation timing, the vehicle category, the service type, and the terms shown at checkout or in the booking confirmation. Emergency situations and force majeure events may be considered on a case-by-case basis, subject to assessment and reasonable proof.

Where applicable, bookings for smaller vehicles may qualify for free cancellation up to twenty-four (24) hours before service start, while larger vehicles, charter services, or multi-day services may be subject to longer notice periods and partial or full cancellation charges.

Order modifications may be limited to passenger name, contact number, passenger count, and luggage quantity within the booked vehicle capacity. Material changes may require cancellation of the original booking and creation of a new booking at the then-current price.

16. Cleaning Fee

We reserve the right to charge a reasonable cleaning fee where a vehicle requires exceptional cleaning due to trash, spills, damage, or unsanitary conditions caused by You or Your party.

17. Baggage and Lost or Misplaced Items

Tikiwini is not responsible for baggage or personal property left in a vehicle. We may make reasonable efforts to assist in locating lost items, but retrieval is not guaranteed.

18. Safety Belts

All passengers must comply with applicable laws and regulations relating to seat belts and other required safety equipment.

ii. Shared Shuttle Transfer Service Terms

1. Fare Structure

Unless otherwise stated, shuttle fares include applicable taxes and fees shown at checkout.

2. Booking Terms

Shuttle rides may generally be scheduled up to twenty-four (24) hours before the scheduled pickup time, subject to availability. Confirmation details, meeting point information, and pickup instructions may be provided by email, SMS, WhatsApp, or through the booking interface.

3. Cancellation and Refund Policy

A full refund may be available where cancellation occurs more than forty-eight (48) hours before the scheduled pickup time. Cancellations made within forty-eight (48) hours may be non-refundable, unless otherwise stated at checkout or required by law.

4. No-Show Policy and Waiting Time

Grace periods, airport meeting instructions, and departure procedures depend on the shuttle type and supplier arrangements. Failure to appear at the designated meeting point or pickup point within the communicated timeframe may be treated as a no-show.

5. Modifications and Changes

Changes made more than forty-eight (48) hours before pickup may be supported subject to availability. Changes requested within forty-eight (48) hours are subject to supplier approval and operational feasibility.

iii. Ride Hailing Service Terms

1. Fare Structure and Additional Charges

Ride hailing fares may be charged upfront based on estimated distance and time. Additional charges may apply for route changes, extra stops, waiting time, tolls, pickup surcharges, drop-off surcharges, traffic-related delays, or destination changes.

2. Booking Terms

Ride hailing services may be booked on-demand or scheduled in advance, subject to availability. Pre-booked rides made sufficiently in advance may also be subject to the Pre-booked Transfer Service Terms.

3. Cancellation and No-Show Policy

A brief free cancellation period may apply after driver acceptance. After that period, a cancellation fee may be charged. If You fail to appear within the allowed waiting time after the driver arrives, a no-show fee may apply.

4. Waiting Time Fee

A limited free waiting period may apply after the driver arrives at the pickup location. Additional waiting time beyond that free period may be chargeable.

5. Refund Policy

Any eligible refund for ride hailing services will generally be processed to the original payment method within a reasonable period.

iv. Rail Tickets Transfer Service Terms

1. Fare Structure and Additional Charges

Rail ticket transfer services may be sold at a fixed rate determined at the time of booking. Additional charges may apply for seat upgrades, class upgrades, destination changes, or customer-requested modifications.

2. Booking Terms and Ancillary Services

Ticket availability depends on carrier inventory and release schedules. All ticket bookings are subject to the specific terms, fare rules, and conditions of the selected rail carrier. Ancillary services, where offered, may include luggage options, bicycle carriage, pet transport, seat reservations, meals, insurance, and similar options, but availability is not guaranteed.

3. Cancellation Policy

The applicable cancellation policy, including refund eligibility and fees, will be shown at the time of booking and may also be included in the booking confirmation.

4. No-Show and Post-Departure Policy

In the event of a no-show for a scheduled rail journey, applicable fares and fees may be non-refundable, subject to the selected fare terms and the carrier’s policy.

5. Refund Policy

Refunds for rail ticket bookings depend on the fare type, carrier rules, and any fees disclosed at the time of booking. Eligible refunds are generally returned to the original payment method.

6. Modifications

Any permitted modifications to travel date, departure time, destination, or seat selection are subject to the fare type, carrier rules, and availability.

v. Refund Protect

For certain bookings, Tikiwini may offer optional booking protection products through third-party partners. Such products, where available, are governed by the terms and conditions of the relevant partner, and Tikiwini is not responsible for that partner’s decisions or policies.

vi. Tikiwini Credits

Tikiwini may, at its discretion, issue promotional credits or booking credits in certain circumstances. Such credits may be subject to expiry dates, usage restrictions, minimum booking values, non-transferability, and other terms communicated at the time of issue.

vii. Customer Support

Customer support may be offered through email, chat, help center articles, or other support channels made available on the Platform. Complaint deadlines and handling procedures may depend on the service category and the underlying supplier or carrier.

viii. Deposits

Deposit payment options may be available for selected bookings. Where a deposit option is used, the remaining balance must be paid by the stated due date. Failure to pay the balance may result in automatic cancellation and forfeiture of the deposit, subject to the terms shown at booking.
